Where applicable under Indian law, processing of children's personal data will be handled in accordance with the requirements applicable to children's data. For information about how EXYLVYIA handles personal information, please refer to our Privacy Policy.
16. Third-Party Services and Links

Third-party services are operated independently from EXYLVYIA and may have their own terms of service, privacy policies, security practices, availability requirements, and user conditions. EXYLVYIA is not responsible for the policies, content, security, or availability of third-party websites or services to the extent permitted by applicable law. Your use of a third-party service is subject to that provider's applicable terms and policies.
17. Website Availability
We aim to keep the EXYLVYIA website available and functioning properly. However, we do not guarantee that the website will always be available, uninterrupted, error-free, current, fully featured, or free from technical problems.
The website may occasionally be unavailable due to maintenance, upgrades, technical problems, security measures, hosting issues, or circumstances beyond our reasonable control.
18. Website Content and Accuracy
We make reasonable efforts to provide useful and accurate information. However, website information may change and may not always reflect the latest programme availability, schedules, fees, faculty arrangements, or other operational details. Where a specific programme or admission decision is important, users should confirm the relevant information directly with EXYLVYIA before relying upon it.
19. No Professional or Guaranteed Advice
Educational information published on the website is provided for general informational and learning purposes. Although we aim for accuracy and quality, educational content may contain errors, omissions, or information that becomes outdated due to curriculum, syllabus, examination, or other changes. Users should verify important academic or examination requirements through the relevant official authorities where appropriate.

Where EXYLVYIA charges fees for educational services, the applicable fee, payment schedule, payment method, and other commercial terms will be communicated through the relevant admission or enrolment process.
Fees may vary depending on course, programme, batch, mode of delivery, duration, services included, and other applicable factors. Unless expressly confirmed in writing, an enquiry or quotation should not be treated as a final admission or fee commitment. Where online payments are introduced or enabled, additional payment, cancellation, refund, or service-specific terms may apply.
21. Refunds and Cancellations
Website payments are not currently enabled. For an applicable paid programme, a learner may request a refund after attending up to two demo classes if they do not understand the concepts, provided the request is emailed to contactus@exylvyia.com within three days of joining. If the learner continues with additional classes after the two demo classes, this refund option is cancelled. An eligible refund may be initiated within 15 days, subject to verification and applicable law.
See the Refund & Cancellation Policy for the applicable request process. Other programme refunds, cancellations, withdrawals or transfers will be governed by the written terms communicated at enrolment or payment. EXYLVYIA may modify, improve, suspend, or discontinue any website feature or educational service from time to time. Changes may be necessary because of curriculum updates, technology changes, operational requirements, security considerations, availability, educational requirements, changes in third-party services, or applicable legal or regulatory requirements. Where a change materially affects an existing paid service, applicable contractual or legal obligations will be respected.
28. Changes to These Terms
EXYLVYIA may update these Terms from time to time. The revised Terms will be published on this page together with an updated "Last Updated" date.
Your continued use of the website after updated Terms are published may constitute acceptance of the revised Terms to the extent permitted by applicable law. If a change materially affects an existing contractual relationship, any notice or consent required by applicable law will be handled appropriately.
29. Governing Law
These Terms shall be governed by and interpreted in accordance with the applicable laws of India, subject to any mandatory legal rights or protections that may apply.
Any dispute arising in connection with these Terms or the use of EXYLVYIA services shall be subject to the jurisdiction of the courts having appropriate jurisdiction under applicable law. Nothing in this clause is intended to deprive a consumer or user of any mandatory rights or remedies available under applicable law.

32. Entire Agreement
These Terms, together with any applicable programme-specific terms, admission terms, payment terms, and Privacy Policy, constitute the applicable understanding between you and EXYLVYIA regarding your use of the relevant website or service, except where a separate written agreement applies.

Such information relates to the learner concerned and is not a guarantee of the same outcome for every learner. Material claims will be presented with reasonable care and in accordance with applicable law, including the CCPA's Guidelines for Prevention of Misleading Advertisement in Coaching Sector, 2024.
35. No Government or Board Affiliation
Unless expressly stated and legally authorised, EXYLVYIA is not a government organisation, government-approved institute, official representative of CBSE, a State Board, school, college, university or examination authority.
36. Programme Information, Fees and Payment
Before enrolment, learners and parents/guardians should review the programme name, subjects, duration, mode, schedule, inclusions, materials, assessments, support, fees and refund/cancellation terms. Applicable fees are communicated before enrolment or payment. Taxes, processing charges or other disclosed charges may apply.
37. Refund and Cancellation Policy
Refunds, cancellations, transfers and withdrawals are governed by the applicable programme policy communicated at enrolment. Payment does not automatically become refundable because a learner does not achieve a desired result, stops attending, changes plans, does not complete a course or does not use all materials. Nothing in these Terms excludes a consumer right or statutory protection that cannot legally be excluded.
38. Study Materials and Personal Educational Licence
Materials may be physical, digital, audio or video and may be updated or replaced. Digital content is licensed solely for the enrolled learner's personal educational purposes and this licence does not transfer ownership.

41. AI-Assisted Educational Tools
AI-generated information may contain inaccuracies, omissions or errors. Learners should verify important academic information against authoritative textbooks, official curriculum documents, examination authorities or qualified educators.
42. Privacy, Personal Data and Minors
Personal information may be processed for providing Services, responding to enquiries, processing payments, maintaining accounts, improving Services and complying with law. Processing is governed by the Privacy Policy and applicable Indian data-protection law. Parents or legal guardians should review consent requirements and supervise minors' use of online Services where appropriate.
43. Complaints and Grievance Redressal

44. Service Modification and Force Majeure
EXYLVYIA may reasonably modify, replace or discontinue aspects of its Services. Material changes affecting a paid programme will be handled subject to applicable programme terms and law. EXYLVYIA is not responsible for interruptions caused by events beyond reasonable control.
45. Limitation of Responsibility for Academic Outcomes
To the extent permitted by law, EXYLVYIA is not responsible for outcomes arising primarily from lack of preparation, insufficient practice, non-attendance, examination performance, examination difficulty, evaluation decisions, cut-offs, competition, eligibility decisions or third-party decisions. This does not exclude liability or consumer remedies that cannot legally be excluded.
46. No Exclusion of Mandatory Legal Rights
Nothing in these Terms excludes a consumer right, statutory remedy, mandatory protection, liability or obligation that cannot legally be excluded or restricted. Mandatory law prevails to the extent of any conflict.
47. Changes, Governing Law and Severability
Revised Terms will be published with an updated date. These Terms are governed by the laws of India, subject to mandatory statutory rights. Any dispute shall be addressed under applicable Indian law and by a legally competent forum. If a provision is invalid or unenforceable, it will be modified or severed only to the extent necessary and the remaining provisions will continue.
48. Entire Agreement and No Waiver
These Terms, programme descriptions, fee information, refund/cancellation policies, Privacy Policy and applicable programme-specific written terms form the applicable agreement concerning the relevant Services. Failure to enforce a provision immediately is not a waiver of the right to enforce it later.
49. Important Academic and Fee Disclaimer
EXYLVYIA provides educational support, not guaranteed academic outcomes. Success requires the learner's own effort, preparation, practice, consistency and performance. Failure to achieve a desired result does not by itself create an automatic right to a refund, subject always to mandatory consumer rights and applicable law.

55. Regulatory Compliance — Guidelines for Regulation of Coaching Centres, 2024
The Ministry of Education, Government of India, issued Guidelines for Registration and Regulation of Coaching Centres on 16 January 2024. These Guidelines are primarily directed at coaching centres that prepare students for competitive entrance, recruitment, or similar examinations, and recommend, among other things, that such coaching centres should not enrol students below 16 years of age and should enrol students only after completion of their secondary school examination (Class X).
EXYLVYIA provides academic tuition and school-curriculum support in Mathematics, Science, Physics, and optional Future Skills, intended to strengthen a student's understanding of their own school syllabus (CBSE/State Board) for Classes X-XII. EXYLVYIA does not operate as, and does not hold itself out as, a coaching centre preparing students for a competitive entrance or recruitment examination such as JEE, NEET, UPSC, or similar examinations.
As a matter of good practice and without prejudice to the foregoing, EXYLVYIA does not enrol any student below 16 years of age, or before completion of their secondary school examination, into any programme, module, or add-on that is specifically designed or advertised as preparation for a competitive entrance or recruitment examination. Where applicable state or local rules framed pursuant to the Guidelines require registration or additional compliance measures, EXYLVYIA will take reasonable steps to comply with such requirements as and when they apply to EXYLVYIA's services.
Consistent with the Guidelines, EXYLVYIA also confirms that it: (a) does not guarantee ranks, selections, or results (see Clause 6 and Clause 34); (b) maintains a transparent, published fee and refund process (see the Refund & Cancellation Policy); (c) provides a named grievance redressal contact (see Clause 43); and (d) does not schedule classes in a manner intended to cause undue academic pressure on learners.
